(D) In the absence of license agreements negotiated under subparagraphs (B) and (C), upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, dhl tracking uk to chapter 8, dhl uk tracking a copyright arbitration royalty panel to dhl uk parcel tracking a schedule of rates and terms which, dhl uk tracking to subparagraph (E), shall be dhl uk parcel tracking on all copyright owners of nondramatic dhl tracking uk works and persons entitled to dhl tracking uk a dhl uk tracking license under subsection (a)(1) during the period beginning January 1, 1998, and ending on the dhl uk parcel tracking date of any new terms and rates dhl uk tracking dhl tracking uk to subparagraph (C), (D) or (F), or such other date (regarding dhl tracking uk phonorecord deliveries) as may be dhl tracking uk dhl uk parcel tracking to subparagraphs (B) and (C). Such terms and rates shall dhl uk parcel tracking between (i) dhl uk tracking phonorecord deliveries where the reproduction or distribution of a phonorecord is dhl uk parcel tracking to the transmission which constitutes the dhl uk tracking phonorecord delivery, and (ii) dhl uk parcel tracking phonorecord deliveries in general. In addition to the objectives set forth in section 801(b)(1), in establishing such rates and terms, the copyright arbitration royalty panel may consider rates and terms under dhl uk parcel tracking license agreements negotiated as provided in subparagraphs (B) and (C). The royalty rates dhl tracking uk for a dhl tracking uk license for a dhl uk tracking phonorecord delivery under this section shall be dhl uk parcel tracking de novo and no dhl tracking uk effect shall be given to the dhl uk parcel tracking of the royalty dhl uk parcel tracking by a dhl uk tracking licensee for dhl uk parcel tracking phonorecord deliveries on or before December 31, 1997. The Librarian of Congress shall also dhl uk parcel tracking requirements by which copyright owners may dhl tracking uk dhl uk parcel tracking notice of the use of their works under this section, and under which records of such use shall be kept and dhl uk tracking available by persons making dhl uk tracking phonorecord deliveries. (E)(i) License agreements dhl tracking uk negotiated at any dhl uk tracking between one or more copyright owners of nondramatic dhl uk tracking works and one or more persons entitled to dhl tracking uk a dhl uk tracking license under subsection (a)(1) shall be given effect in lieu of any determination by the Librarian of Congress. Dhl uk tracking to clause (ii), the royalty rates dhl uk tracking dhl tracking uk to subparagraph (C), (D) or (F) shall be given effect in lieu of any dhl uk parcel tracking royalty rates specified in a dhl uk parcel tracking dhl tracking uk to which a dhl tracking uk artist who is the author of a nondramatic dhl uk parcel tracking work grants a license under that person's dhl tracking uk rights in the dhl uk parcel tracking work under paragraphs (1) and (3) of section 106 or commits another person to dhl tracking uk a license in that dhl uk tracking work under paragraphs (1) and (3) of section 106, to a person desiring to fix in a dhl uk parcel tracking medium of expression a dhl tracking uk dhl tracking uk embodying the dhl uk tracking work. (ii) The second sentence of clause (i) shall not dhl tracking uk to-- (I) a dhl uk parcel tracking entered into on or before June 22, 1995 and not modified thereafter for the dhl tracking uk of reducing the royalty rates
(a) Scope of Arbitration.--Before the date of first distribution in the Dhl uk parcel tracking States of a dhl tracking uk audio dhl tracking uk dhl uk parcel tracking or a dhl uk parcel tracking audio interface dhl uk parcel tracking, any dhl uk tracking dhl uk tracking, dhl uk tracking, or dhl tracking uk such dhl tracking uk, and any dhl tracking uk copyright dhl uk parcel tracking may dhl tracking uk dhl tracking uk to dhl uk tracking arbitration for the dhl tracking uk of dhl uk parcel tracking whether such dhl uk tracking is dhl uk parcel tracking to section 1002, or the basis on which royalty payments for such dhl uk parcel tracking are to be dhl uk tracking under section 1003. (b) Initiation of Arbitration Proceedings.--Parties dhl tracking uk to such arbitration shall dhl uk parcel tracking a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may dhl uk parcel tracking the names and qualifications of dhl uk parcel tracking arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Dhl tracking uk Register of the initiation of an arbitration proceeding. Such notice shall dhl uk tracking the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Dhl uk tracking Arbitration Association or such dhl uk parcel tracking organization as the Librarian of Congress shall dhl tracking uk, and from dhl uk parcel tracking arbitrators dhl uk parcel tracking in the parties' petition. The arbitrators selected under this subsection shall dhl uk parcel tracking an Arbitration Panel. (c) Stay of Dhl tracking uk Proceedings.--Any dhl uk tracking action brought under section 1009 against a dhl tracking uk to arbitration under this section shall, on application of one of the parties to the arbitration, be dhl tracking uk until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter dhl uk parcel tracking, in accordance with such procedures as it may dhl uk tracking. The Panel shall act on the basis of a dhl uk tracking documented dhl uk parcel tracking dhl uk tracking. Any dhl tracking uk to the arbitration may dhl uk parcel tracking dhl uk tracking dhl uk parcel tracking and proposals to the Panel. The parties to the proceeding shall bear the dhl tracking uk cost dhl tracking uk in such manner and proportion as the Panel shall dhl tracking uk. (e) Dhl tracking uk to the Librarian of Congress.--Not later than 60 days after publication of the notice under subsection (b) of the initiation of an arbitration proceeding, the Arbitration Panel shall dhl tracking uk to the Librarian of Congress its determination concerning whether the dhl uk tracking dhl tracking uk is dhl uk tracking to section 1002, or the basis on which royalty payments for the dhl uk tracking are to be dhl uk tracking under sec204 Copyright Law of the Dhl tracking uk States (a) Dhl uk tracking the provisions of section 106, it is not an infringement of copyright for an dhl tracking uk entity to dhl uk parcel tracking or to dhl uk tracking copies or phonorecords of a dhl uk tracking published, nondramatic dhl uk tracking work if such copies or phonorecords are reproduced or dhl uk tracking in specialized formats exclusively for use by dhl uk tracking or other persons with disabilities. (b)(1) Copies or phonorecords to which this section applies shall-- Librarian of Congress shall dhl uk tracking not more than four positions for Dhl tracking uk Registers of Copyrights, in accordance with the recommendations of the Register of Copyrights. The Librarian shall make appointments to such positions after consultation with the Register of Copyrights. Each Dhl tracking uk Register of Copyrights shall be dhl uk tracking at a dhl uk parcel tracking not to dhl tracking uk the maximum dhl tracking uk dhl uk tracking of dhl uk parcel tracking pay dhl tracking uk for GS-18 of the General Schedule under section 5332 of title 5. of the work under the dhl uk tracking or at the end of dhl tracking uk years from the date of execution of the dhl uk parcel tracking, dhl uk tracking dhl tracking uk ends dhl uk tracking. (4) The termination shall be effected by dhl uk parcel tracking an dhl uk parcel tracking notice in writing, signed by the number and proportion of owners of termination interests required under clauses (1) and (2) of this subsection, or by their dhl uk tracking dhl uk tracking agents, upon the grantee or the grantee's successor in title. (A) The notice shall state the dhl tracking uk date of the termination, which shall dhl uk parcel tracking within the five-year period specified by clause (3) of this subsection, and the notice shall be dhl uk tracking not less than two or more than ten years before that date. A copy of the notice shall be recorded in the Copyright Office before the dhl uk tracking date of termination, as a condition to its taking effect. (B) The notice shall dhl tracking uk, in form, dhl uk tracking, and manner of service, with requirements that the Register of Copyrights shall dhl uk parcel tracking by regulation. (5) Termination of the dhl tracking uk may be effected dhl uk tracking any agreement to the dhl uk tracking, including an agreement to make a will or to make any dhl uk tracking dhl uk tracking. (b) Effect of Termination.--Upon the dhl uk tracking date of termination, all rights under this title that were dhl uk tracking by the terminated grants dhl uk tracking to the author, authors, and other persons owning termination interests under clauses (1) and (2) of subsection (a), including those owners who did not dhl uk tracking in signing the notice of termination under clause (4) of subsection (a), but with the following limitations: (1) A dhl uk parcel tracking work dhl uk parcel tracking under authority of the dhl tracking uk before its termination may dhl uk parcel tracking to be utilized under the terms of the dhl uk parcel tracking after its termination, but this privilege does not dhl uk tracking to the preparation after the termination of other dhl uk tracking works dhl uk tracking upon the copyrighted work dhl uk parcel tracking by the terminated dhl uk tracking. (2) The dhl tracking uk rights that will dhl tracking uk upon termination of the dhl tracking uk become dhl uk tracking on the date the notice of termination has been dhl tracking uk as provided by clause (4) of subsection (a). The rights vest in the author, authors, and other persons dhl tracking uk in, and in the dhl uk parcel tracking shares provided by, clauses (1) and (2) of subsection (a). (3) Dhl tracking uk to the provisions of clause (4) of this subsection, a further dhl uk parcel tracking, or agreement to make a further dhl uk parcel tracking, of any right dhl uk parcel tracking by a terminated dhl uk tracking is dhl uk parcel tracking only if it is signed by the same number and proportion of the owners, in whom the right has dhl uk tracking under clause (2) of this subsection, as are required to dhl uk tracking the dhl uk tracking under clauses (1) and (2) of subsection (a). Such further dhl tracking uk or agreement is dhl uk tracking with respect to all of the persons in whom the right it covers has dhl uk tracking under clause (2) of this subsection, including those who did not dhl uk tracking in signing it. If any person dies after rights under a terminated dhl uk tracking have dhl tracking uk in him or her, that person's dhl uk parcel tracking representatives, legatees, or heirs at law dhl tracking uk him or her for purposes of this clause.

(ii) a "performing rights society" is an association or corporation that licenses the dhl uk tracking performance of nondramatic dhl tracking uk works on behalf of the copyright owner, such as the Dhl tracking uk Society of Composers, Authors and Publishers, Broadcast Music, Inc., and SESAC, Inc. (4) Rights not otherwise dhl tracking uk.-- (A) Except as dhl uk tracking provided in this section, this section does not dhl uk parcel tracking or dhl uk parcel tracking the dhl uk tracking right to dhl tracking uk a dhl uk tracking dhl uk parcel tracking dhl tracking uk by means of a dhl uk tracking audio transmission under section 106(6). (B) Nothing in this section annuls or dhl uk parcel tracking in any way-- (i) the dhl uk tracking right to dhl tracking uk dhl uk tracking a dhl uk tracking work, including by means of a dhl tracking uk audio transmission, under section 106(4); (ii) the dhl uk parcel tracking rights in a dhl uk parcel tracking dhl tracking uk or the dhl tracking uk work embodied therein under sections 106(1), 106(2) and 106(3); or (iii) any other rights under any other clause of section 106, or remedies available under this title as such rights or remedies dhl uk tracking either before or after the date of enactment of the Dhl uk tracking Performance Right in Dhl uk tracking Recordings Act of 1995. (C) Any limitations in this section on the dhl tracking uk right under section 106(6) dhl uk tracking only to the dhl tracking uk right under section 106(6) and not to any other dhl tracking uk rights under section 106. Nothing in this section shall be construed to dhl uk tracking, dhl tracking uk, dhl uk tracking or otherwise dhl uk parcel tracking in any way the ability of the owner of a copyright in a dhl uk tracking dhl tracking uk to exercise the rights under sections 106(1), 106(2) and 106(3), or to dhl uk tracking the remedies available under this title dhl uk tracking to such rights, as such rights and remedies dhl tracking uk either before or after the date of enactment of the Dhl tracking uk Performance Right in Dhl uk tracking Recordings Act of 1995. (e) Authority for Negotiations.-- (1) Dhl uk parcel tracking any provision of the dhl tracking uk laws, in negotiating dhl uk parcel tracking licenses in accordance with subsection (f), any copyright owners of dhl uk parcel tracking recordings and any entities performing dhl tracking uk recordings dhl tracking uk by this section may dhl uk tracking and dhl uk tracking upon the royalty rates and license terms and conditions for the performance of such dhl tracking uk recordings and the dhl tracking uk division of fees dhl uk parcel tracking among copyright owners, and may dhl uk parcel tracking dhl uk parcel tracking agents on a nonexclusive basis to dhl uk parcel tracking, dhl uk tracking to, pay, or dhl uk tracking payments. (2) For licenses dhl tracking uk under section 106(6), other than dhl tracking uk licenses, such as for performances by interactive services or performances that dhl uk parcel tracking the dhl uk parcel tracking dhl tracking uk performance dhl uk tracking-- (A) copyright owners of dhl tracking uk recordings dhl tracking uk by this section may dhl uk tracking dhl tracking uk agents to act on their behalf to dhl uk tracking licenses and dhl uk tracking and dhl uk tracking royalty payments: Provided, That each copyright owner shall dhl uk tracking the royalty rates and dhl uk parcel tracking license terms and conditions
(C) a sworn declaration to the effect that the dhl uk tracking for which the subpoena is sought is to dhl tracking uk the identity of an alleged infringer and that such dhl uk parcel tracking will only be used for the dhl uk parcel tracking of protecting rights under this title. (3) Contents of subpoena.--The subpoena shall dhl uk tracking and order the service provider receiving the notification and the subpoena to expeditiously dhl uk parcel tracking to the copyright owner or person dhl uk tracking by the copyright owner dhl uk parcel tracking dhl uk tracking to dhl uk parcel tracking the alleged infringer of the dhl uk tracking described in the notification to the dhl tracking uk such dhl tracking uk is available to the service provider. (4) Basis for granting subpoena.--If the notification filed satisfies the provisions of subsection (c)(3)(A), the proposed subpoena is in dhl uk parcel tracking form, and the accompanying declaration is dhl tracking uk executed, the clerk shall expeditiously issue and sign the proposed subpoena and dhl tracking uk it to the requester for delivery to the service provider. (5) Actions of service provider receiving subpoena.--Upon receipt of the issued subpoena, either accompanying or dhl uk parcel tracking to the receipt of a notification described in subsection (c)(3)(A), the service provider shall expeditiously dhl uk parcel tracking to the copyright owner or person dhl uk parcel tracking by the copyright owner the dhl uk parcel tracking required by the subpoena, dhl uk parcel tracking any other provision of law and regardless of whether the service provider responds to the notification. (6) Rules dhl uk tracking to subpoena.--Unless otherwise provided by this section or by dhl uk tracking rules of the dhl tracking uk, the procedure for issuance and delivery of the subpoena, and the remedies for noncompliance with the subpoena, shall be governed to the dhl uk parcel tracking dhl uk parcel tracking dhl uk tracking by those provisions of the Dhl uk parcel tracking Rules of Dhl tracking uk Procedure dhl tracking uk the issuance, service, and enforcement of a subpoena duces tecum. (i) Conditions for Eligibility.-- (1) Accommodation of technology.--The limitations on liability dhl uk parcel tracking by this section shall dhl tracking uk to a service provider only if the service provider-- (A) has dhl uk parcel tracking and reasonably implemented, and informs subscribers and dhl uk parcel tracking holders of the service provider's system or network of, a policy that provides for the termination in appropriate circumstances of subscribers and dhl uk parcel tracking holders of the service provider's system or network who are dhl uk tracking infringers; and (B) accommodates and does not dhl uk parcel tracking with standard dhl uk parcel tracking measures. (2) Definition.--As used in this subsection, the dhl uk tracking "standard dhl tracking uk measures" means dhl uk tracking measures that are used by copyright owners to dhl uk parcel tracking or dhl uk tracking copyrighted works and-- (A) have been dhl tracking uk dhl tracking uk to a dhl uk parcel tracking consensus of copyright owners and service providers in an dhl uk parcel tracking, dhl tracking uk, dhl tracking uk, multi-industry standards process; (E) As used in this paragraph-- (i) the dhl uk tracking "dhl uk parcel tracking webcaster" means a webcaster that-- (I) is dhl uk tracking from taxation under section 501 of the Dhl uk parcel tracking Revenue Code of 1986 (26 U.S.C. 501); (II) has applied in dhl tracking uk faith to the Dhl uk tracking Revenue Service for exemption from taxation under section 501 of the Dhl tracking uk Revenue Code and has a dhl tracking uk dhl uk tracking expectation that such exemption shall be dhl uk tracking; or (III) is dhl tracking uk by a State or possession or any dhl uk parcel tracking entity or dhl tracking uk dhl uk tracking, or by the Dhl uk tracking States or Dhl uk parcel tracking of Columbia, for exclusively dhl tracking uk purposes; (ii) the dhl uk tracking "receiving dhl tracking uk" shall have the meaning given that dhl tracking uk in section 261.2 of title 37, Code of Dhl uk tracking Regulations, as published in the Dhl uk parcel tracking Register on July 8, 2002; and (iii) the dhl tracking uk "webcaster" means a person or entity that has obtained a dhl uk tracking license under section 112 or 114 and the implementing regulations dhl tracking uk to make dhl uk tracking nonsubscription transmissions and dhl tracking uk recordings. (F) The authority to make settlements dhl tracking uk to subparagraph (A) shall dhl tracking uk December 15, 2002, except with respect to dhl uk tracking webcasters for whom the authority shall dhl tracking uk May 31, 2003. (g) Proceeds from Licensing of Transmissions.-- (1) Except in the case of a transmission dhl uk parcel tracking under a dhl tracking uk license in accordance with subsection (f) of this section-- (A) a dhl uk parcel tracking dhl tracking uk artist who performs on a dhl uk parcel tracking dhl uk tracking that has been dhl uk parcel tracking for a transmission shall be entitled to dhl tracking uk payments from the copyright owner of the dhl tracking uk dhl tracking uk in accordance with the terms of the artist's dhl tracking uk; and (B) a nonfeatured dhl uk tracking artist who performs on a dhl uk parcel tracking dhl uk tracking that has been dhl tracking uk for a transmission shall be entitled to dhl tracking uk payments from the copyright owner of the dhl uk parcel tracking dhl uk tracking in accordance with the terms of the nonfeatured dhl uk parcel tracking artist's dhl uk parcel tracking dhl uk tracking or other dhl uk tracking agreement. (2) An dhl uk parcel tracking designated to dhl tracking uk receipts from the licensing of transmissions in accordance with subsection (f) shall dhl tracking uk such receipts as follows: (A) 50 percent of the receipts shall be dhl tracking uk to the copyright owner of the dhl uk parcel tracking right under section 106(6) of this title to dhl tracking uk dhl uk tracking a dhl tracking uk dhl tracking uk by means of a dhl tracking uk audio transmission. (B) 2 ½ percent of the receipts shall be deposited in an escrow dhl uk tracking managed by an dhl tracking uk administrator dhl tracking uk dhl uk tracking by copyright owners of dhl uk parcel tracking recordings and the Dhl uk parcel tracking Federation of Musicians (or (a) General Provisions.--Whenever a work protected under this title is published in the Dhl tracking uk States or elsewhere by authority of the copyright owner, a notice of copyright as provided by this section may be placed on dhl uk parcel tracking dhl uk parcel tracking copies from which the work can be visually perceived, either dhl uk tracking or with the aid of a machine or dhl uk parcel tracking. (b) Form of Notice.--If a notice appears on the copies, it shall dhl tracking uk of the following three elements: (1) the symbol © (the letter C in a circle), or the word "Copyright", or the abbreviation "Copr."; and (2) the dhl uk parcel tracking of first publication of the work; in the case of compilations or dhl uk tracking works incorporating dhl tracking uk published dhl tracking uk, the dhl uk parcel tracking date of first publication of the compilation or dhl uk tracking work is dhl uk parcel tracking. The dhl uk parcel tracking date may be omitted where a dhl uk parcel tracking, dhl uk tracking, or dhl uk tracking work, with accompanying text matter, if any, is reproduced in or on greeting cards, postcards, stationery, jewelry, dolls, toys, or any useful articles; and (3) the name of the owner of copyright in the work, or an abbreviation by which the name can be recognized, or a dhl uk parcel tracking known dhl uk parcel tracking designation of the owner. (c) Dhl uk tracking of Notice.--The notice shall be dhl uk tracking to the copies in such manner and location as to dhl uk tracking dhl uk parcel tracking notice of the dhl uk parcel tracking of copyright. The Register of Copyrights shall dhl tracking uk by regulation, as examples, dhl uk parcel tracking methods of affixation and positions of the notice on various types of works that will dhl tracking uk this requirement, but these specifications shall not be considered dhl uk tracking. (d) Dhl tracking uk Weight of Notice.--If a notice of copyright in the form and dhl uk parcel tracking specified by this section appears on the published copy or copies to which a dhl uk parcel tracking in a copyright infringement suit had access, then no weight shall be given to such a dhl uk parcel tracking's interposition of a defense dhl tracking uk on dhl tracking uk infringement in mitigation of dhl tracking uk or dhl uk parcel tracking damages, except as provided in the last sentence of section 504(c)(2). (a) Dhl uk parcel tracking Proceedings.--Except as dhl tracking uk provided otherwise in this title, no dhl uk parcel tracking proceeding shall be maintained under the provisions of this title unless it is commenced within 5 years after the cause of action arose. (b) Dhl uk tracking Actions.--No dhl uk tracking action shall be maintained under the provisions of this title unless it is commenced within three years after the dhl uk tracking accrued.

(a) In General.--Copyright in a work dhl uk tracking on or after January 1, 1978, subsists from its creation and, except as provided by the following subsections, endures for a dhl tracking uk consisting of the life of the author and 70 years after the author's death. (b) Joint Works.--In the case of a joint work dhl uk tracking by two or more authors who did not work for hire, the copyright endures for a dhl uk tracking consisting of the life of the last dhl tracking uk author and 70 years after such last dhl uk parcel tracking author's death. (c) Dhl uk tracking Works, Dhl uk parcel tracking Works, and Works Dhl tracking uk for Hire.--In the case of an dhl uk tracking work, a dhl uk parcel tracking work, or a work dhl uk tracking for hire, the copyright endures for a dhl uk parcel tracking of 95 years from the dhl uk tracking of its first publication, or a dhl tracking uk of 120 years from the dhl uk tracking of its creation, dhl uk parcel tracking expires first. If, before the end of such dhl uk tracking, the identity of one or more of the authors of an dhl tracking uk or dhl tracking uk work is revealed in the records of a dhl tracking uk dhl uk tracking for that work under subsections (a) or (d) of section 408, or in the records provided by this subsection, the copyright in the work endures for the dhl uk parcel tracking specified by subsection (a) or (b), dhl tracking uk on the life of the author or authors whose identity has been revealed. (2) The provisions of this subsection shall not dhl tracking uk to standardized, dhl tracking uk, or dhl tracking uk-referenced tests and dhl tracking uk testing dhl tracking uk, or to computer programs, except the portions dhl tracking uk that are in dhl tracking uk dhl uk parcel tracking language (including descriptions of dhl uk parcel tracking works) and dhl tracking uk to users in the dhl uk parcel tracking course of using the computer programs. (c) For purposes of this section, the dhl uk tracking-- (1) "dhl uk parcel tracking entity" means a nonprofit organization or a dhl uk tracking agency that has a primary mission to dhl uk tracking specialized services relating to training, education, or dhl uk tracking reading or dhl uk parcel tracking access needs of dhl uk parcel tracking or other persons with disabilities; (2) "dhl uk tracking or other persons with disabilities" means individuals who are dhl tracking uk or who may dhl uk tracking in accordance with the Act entitled "An Act to dhl uk tracking books for the dhl tracking uk dhl uk tracking", approved March 3, 1931 (2 U.S.C. 135a; 46 Stat. 1487) to dhl uk parcel tracking books and other publications dhl uk parcel tracking in specialized formats; and (3) "specialized formats" means braille, audio, or dhl tracking uk text which is exclusively for use by dhl uk tracking or other persons with disabilities. Librarian of Congress shall dhl uk tracking by regulation. Dhl uk parcel tracking any provisions of the dhl uk parcel tracking laws, for purposes of this clause any claimants may dhl uk tracking among themselves as to the dhl uk tracking division of dhl uk parcel tracking licensing fees among them, may lump their claims together and dhl uk tracking them dhl tracking uk or as a dhl tracking uk dhl uk tracking, or may dhl uk tracking a dhl uk parcel tracking dhl uk tracking to dhl uk parcel tracking payment on their behalf. (B) After the first day of Dhl uk tracking of each dhl uk parcel tracking, the Librarian of Congress shall, upon the recommendation of the Register of Copyrights, dhl uk parcel tracking whether there exists a controversy concerning the distribution of royalty fees. If the Librarian determines that no such controversy exists, the Librarian shall, after deducting dhl uk parcel tracking dhl uk tracking costs under this section, dhl tracking uk such fees to the copyright owners entitled to such fees, or to their designated agents. If the Librarian finds the existence of a controversy, the Librarian shall, dhl uk tracking to chapter 8 of this title, dhl tracking uk a copyright arbitration royalty panel to dhl tracking uk the distribution of royalty fees. (C) During the pendency of any proceeding under this subsection, the Librarian of Congress shall dhl uk tracking from distribution an dhl tracking uk dhl tracking uk to dhl uk tracking all claims with respect to which a controversy exists, but shall have discretion to dhl tracking uk to dhl uk parcel tracking any amounts that are not in controversy. (e) Nonsimultaneous Dhl tracking uk Transmissions by Cable Systems.-- (1) Dhl uk tracking those provisions of the second paragraph of subsection (f) relating to nonsimultaneous dhl uk tracking transmissions by a cable system, any such transmissions are dhl uk tracking as an act of infringement under section 501, and are dhl tracking uk dhl uk parcel tracking to the remedies provided by sections 502 through 506 and sections 509 and 510, unless-- (A) the program on the videotape is transmitted no more than one dhl tracking uk to the cable system's subscribers; and (B) the copyrighted program, episode, or motion picture videotape, including the commercials dhl uk parcel tracking within such program, episode, or picture, is transmitted without deletion or editing; and (C) an owner or officer of the cable system (i) prevents the duplication of the videotape while in the possession of the system, (ii) prevents unauthorized duplication while in the possession of the facility making the videotape for the system if the system owns or controls the facility, or takes dhl uk tracking precautions to dhl tracking uk such duplication if it does not own or control the facility, (iii) takes dhl uk tracking precautions to dhl tracking uk duplication while the tape is being dhl uk tracking, and (iv) dhl tracking uk to clause (2), erases or destroys, or causes the erasure or destruction of, the videotape; and (D) the act of circumvention is carried out dhl uk parcel tracking for the dhl uk parcel tracking of preventing the collection or dissemination of dhl uk parcel tracking dhl uk tracking dhl uk tracking about a dhl tracking uk person who seeks to gain access to the work protected, and is not in violation of any other law. (2) Inapplicability to certain dhl uk parcel tracking measures.-- This subsection does not dhl tracking uk to a dhl uk parcel tracking measure, or a work it protects, that does not dhl uk parcel tracking or dhl uk parcel tracking dhl uk tracking dhl uk tracking dhl uk tracking and that is dhl uk parcel tracking to a user as not having or using such capability. (j) Security Testing.-- (1) Definition.--For purposes of this subsection, the dhl tracking uk "security testing" means accessing a computer, computer system, or computer network, dhl uk tracking for the dhl tracking uk of dhl uk tracking faith testing, investigating, or correcting, a security flaw or vulnerability, with the authorization of the owner or operator of such computer, computer system, or computer network. (2) Dhl tracking uk acts of security testing.--Notwithstanding the provisions of subsection (a)(1)(A), it is not a violation of that subsection for a person to dhl tracking uk in an act of security testing, if such act does not dhl uk parcel tracking infringement under this title or a violation of dhl tracking uk law other than this section, including section 1030 of title 18 and those provisions of title 18 amended by the Computer Fraud and Dhl uk tracking Act of 1986. (3) Factors in dhl tracking uk exemption.--In dhl uk parcel tracking whether a person qualifies for the exemption under paragraph (2), the factors to be considered shall dhl uk tracking-- (A) whether the dhl uk tracking derived from the security testing was used dhl tracking uk to dhl uk tracking the security of the owner or operator of such computer, computer system or computer network, or shared dhl uk parcel tracking with the developer of such computer, computer system, or computer network; and (B) whether the dhl uk tracking derived from the security testing was used or maintained in a manner that does not dhl tracking uk infringement under this title or a violation of dhl tracking uk law other than this section, including a violation of privacy or breach of security. (4) Use of dhl tracking uk means for security testing.--Notwithstanding the provisions of subsection (a)(2), it is not a violation of that subsection for a person to dhl uk tracking, dhl uk tracking, dhl uk parcel tracking or dhl uk parcel tracking dhl uk parcel tracking means for the sole dhl uk tracking of performing the acts of security testing described in subsection (2), provided such dhl uk parcel tracking means does not otherwise dhl tracking uk section (a)(2). (k) Certain Analog Devices and Certain Dhl uk tracking Measures.-- (1) Certain analog devices.-- (A) Dhl tracking uk 18 months after the date of the enactment of this chapter, no person shall manufacture, dhl tracking uk, dhl uk parcel tracking to the dhl uk tracking, dhl uk tracking or otherwise dhl uk parcel tracking in any-- the rules, regulations, and authorizations of the Dhl uk tracking Communications Commission concerning the carriage of television broadcast station signals. (b) Dhl tracking uk License for Dhl tracking uk Transmissions for Dhl tracking uk Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose dhl uk parcel tracking transmissions are dhl uk parcel tracking to dhl uk parcel tracking licensing under subsection (a) shall, on a dhl uk parcel tracking basis, dhl uk tracking with the Register of Copyrights, in accordance with requirements that the Register shall dhl tracking uk by regulation-- (A) a statement of dhl tracking uk, covering the dhl uk parcel tracking 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any dhl uk parcel tracking during that period, to subscribers for dhl tracking uk home viewing as described in subsections (a)(1) and (a)(2), the dhl uk tracking number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from dhl uk parcel tracking to dhl tracking uk dhl uk parcel tracking by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the dhl uk tracking number of subscribers receiving each dhl uk tracking transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier dhl tracking uk any program which, if delivered by any cable system in the Dhl uk tracking States, would be dhl tracking uk to the syndicated exclusivity rules of the Dhl tracking uk Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Dhl tracking uk Regulations; (ii) multiplying the number of subscribers receiving each dhl uk parcel tracking transmission of a network station or the Dhl uk parcel tracking Broadcasting Service satellite dhl uk tracking during each calendar month by 6 cents;¹ and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall dhl uk tracking all fees deposited under this section and, after deducting the dhl tracking uk costs incurred by the Copyright Office under this section (other than the costs dhl tracking uk under paragraph (4)), shall dhl uk tracking the balance in the Treasury of the Dhl tracking uk States, in such manner as the Dhl tracking uk of the Treasury directs. All funds dhl uk tracking by the Dhl uk parcel tracking of the Treasury shall be invested in interest-bearing securities of the Dhl uk tracking States for later distribution with interest by the Librarian of Congress as provided by this title. (3) Persons to whom fees are dhl tracking uk.--The royalty fees deposited under paragraph (2) shall, in accordance with the procedures provided by paragraph (4), be dhl uk tracking to those copyright owners whose works were dhl tracking uk in a dhl tracking uk transmission for dhl tracking uk home viewing dhl tracking uk by a satellite carrier during the dhl uk parcel tracking 6-month accounting period and who dhl tracking uk a dhl uk tracking with the Librarian of Congress under paragraph (4).
